NYC LAW DEPARTMENT – SPECIAL FEDERAL LITIGATION

The Special Federal Litigation Division of the New York City Law Department seeks an admitted attorney with three years or more of litigation experience to defend the City and its officials in civil rights cases brought in federal court in which police, district attorney or correction officer misconduct is alleged. These cases arise from contact between citizens and law enforcement officers in three contexts: police operations, the prosecution of criminal proceedings, and the custody of arrested individuals in the City’s detention facilities. Suits are typically brought by those who believe their constitutional rights were violated in the course of an attest and subsequent prosecution, or on account of events in City jails. Most division attorneys handle their own caseloads, and are responsible for litigating cases from start to finish, including drafting pleadings, engaging in motion practice, taking and defending depositions, and conducting federal court jury trials.

Applicants must have a minimum of three years of legal experience following graduation from an ABA accredited law school, preferably in federal practice, municipal liability, constitutional or personal injury law. Applicants must be admitted to practice law in the State of New York and be admitted or eligible for immediate admission to the SDNY and EDNY. Applicants must have demonstrated strong legal writing and oral advocacy skills.

NYC LAW DEPARTMENT – JOB POSTING FOR THE GENERAL LITIGATION DIVISION

The General Litigation Division of the NYC Law Department seeks an experienced attorney to represent the City in federal and state court litigation challenging important programs in diverse areas including education, health care, public assistance benefits, prison conditions, foster care, campaign finance and election law. Many of the division’s cases are brought as class actions in federal court and raise complex and novel issues of statutory and constitutional construction. Recent matters have involved the constitutionality of the City’s campaign finance law under the Supreme Court’s Citizens United ruling, the constitutionality of the City Department of Education’s policy denying use of school buildings for worship services by religious groups, and the legality under the ADA of the City’s emergency response with respect to providing appropriate accommodations for disabled individuals during emergencies such as Hurricane Sandy. Division lawyers are responsible for their own caseloads and handle court conferences, oral arguments, depositions, the preparation of legal papers, and hearings and trials in their cases.

Applicants must have at least 2 years of relevant work experience following graduation from an ABA accredited law school and must be admitted and in good standing in New York State. Ideal applicants should demonstrate substantial litigation experience, exceptional organizational abilities, strong legal writing and analytical skills, strong interpersonal skills and excellent judgment.
